The Sebastian County Quorum Court has repealed the gun ban at Ben Geren Park. The signs should come down soon!
Thanks to Heavyhauler for showing up, along with some other interested gun nuts! |

The Quorum Court agenda tonight was really full, and they moved the Ben Geren gun ban repeal to the very last. The meeting started at 7 pm, but they didn't get to our subject until about 8:30. When it was introduced, Prosecuting Attorney Dan Shue was asked to come up and talk about it, and he pretty much elaborated about the items covered in his letter to Judge Hudson. One point he tried to emphasize was the fact nobody had been arrested under the previous law. I don't know what point he was trying to get across, but the message I got was guns were not a problem at Ben Geren Park! He summarized by saying there was no direction to go but to repeal the gun ban. The Justices of the Peace obliged! I got up after the vote, and asked what the future of the signs were; Judge Hudson said that was taken care of when the voted for the repeal of the gun ban. In other words, the signs are coming down! |

The signs were NOT down. To tell you the truth, I'm afraid I might have to remind them soon.
BUT.... The signs won't mean anything if someone wants to carry legally there. That is established. The signs will have to come down soon, though! |

signs...especially ones not to legal standard...and even more especially ones that prohibit lawful carry in a manner unauthorized by state law...mean absolutly nothing. |

I know they mean nothing, you know they mean nothing as well as the rest of our well informed community. I think they should be removed to protect the informed from the ignorant. Let’s say Woodrow goes to Ben Geren for a pick nick lunch. Woodrow is wearing an IWB holstered pistol. As he unpacks his basket a gust of wind dispenses his napkins across the park. Woodrow, never one to litter, gives chase to the fleeing napkins. In an awkward running grab Woodrow’s shirt comes up revealing his sidearm. A park patron remembering the sign starts to analyze what they just saw. How will it be analyzed? Will it be, “The sign says no firearms, he’s breaking the law, let me call the police,” or will it be, “Ooops! Ya flashed me! Be careful open carry isn’t legal yet.” Odds are when the situation is explained to an officer they will realize nothing “criminal” is going on. However, I personally don’t want my pick nick interrupted over such pap.
Before I get inundated with comments and emails on the need for provisions of some sort, whether it be open carry or just an amendment to the concealed carry law, protecting us from unintended exposure and printing, let me say this. It seems like I have read/heard somewhere maybe on the ARCCA forum or on a segment of the Dave Elswick Show that no Arkansas CHCL has been revoked due to either the printing of a handgun or the exposure of a handgun. I’m not saying this replaces the need for clearer language in our gun laws, but I wanted to add it all the same… I’ll track that info down and share my findings. |

Not to take away from what your saying..just pointing out some legal points
a MWAG call is not RAS for a Officer to conduct a Terry stop on the person the call was made about |

I received an email from Joe Gaa, Sebastian County Parks Director, telling me the replacement signs are being made and will be up soon. The existing signs are handmade, and they want to be sure and match them up to look good.
I believe the Ben Geren Park concealed carry episode is over. |

Wow. A business venture with absolutely no business plan. Makes sense to me! That sounds nothing like spam. It must be real!!!
And in other news...... congrats on getting something done on the park thing. I wonder if you could get the old sign for a souvenir? |

Reverend, that is a GREAT idea! I wonder if they like me well enough now to do that for me...
But it can't hurt to ask! |
